These Terms of Service ("Terms") govern your use of Seegnals, a cold-email sending and reply-management platform operated by Creathink One ("Seegnals", "we", "us"), available at seegnals.com and app.seegnals.com. By creating an account, you agree to these Terms.
1. The service
Seegnals lets you connect your own email mailbox(es), build multi-step email sequences, send them to prospects you provide, and manage replies in a unified inbox. We provide the software; you provide the mailbox, the prospect list, and the content.
2. Your account
You must provide accurate information to register and are responsible for all activity under your account and for keeping your login credentials confidential. You must be legally able to enter into a binding contract to use Seegnals on behalf of a business.
3. Your responsibility for who you contact
You are solely responsible for the prospects you upload and contact through Seegnals, including having a lawful basis to email them under the laws that apply to you and to them (for example GDPR in the EU, CAN-SPAM and state laws in the US, or equivalent rules elsewhere). Seegnals does not verify or vouch for any prospect list you upload. We act as a processor of your prospects' data on your instructions. See our Privacy Policy and Data Processing Agreement.
4. Acceptable use
To protect deliverability for you and every other customer sharing our sending infrastructure, you agree not to:
- Upload purchased, scraped, or rented contact lists without a lawful basis to contact the people on them;
- Send unsolicited bulk email that violates CAN-SPAM, GDPR, PECR/UK PECR, CASL, or equivalent anti-spam law in the recipient's jurisdiction;
- Send content that is fraudulent, deceptive, defamatory, or that infringes someone else's rights;
- Omit a functioning unsubscribe mechanism (Seegnals adds one automatically, and you must not attempt to remove or disable it);
- Use Seegnals to send malware, phishing content, or to harass any person;
- Attempt to circumvent sending limits, rate limits, or suppression lists.
We may pause or terminate a campaign, mailbox, or account that we reasonably believe violates this policy, with or without notice, to protect our infrastructure and other customers. A high bounce rate will automatically pause a campaign (see in-app bounce-rate safeguard).
5. Plans, billing, and cancellation
Paid plans are billed on a recurring basis (monthly, unless stated otherwise at checkout) based on the number of contacted people per billing period, as described on our pricing page. If you exceed your plan's included volume, the overage is billed rather than your campaigns being stopped. You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law. We may change our prices with at least 30 days' notice before they apply to your next billing cycle.
6. Your content and our license
You retain all rights to the prospect data, email content, and other material you upload to Seegnals. You grant us a limited license to host, process, and transmit that content solely to provide the service to you. We claim no ownership over your content.
7. Our intellectual property
Seegnals, our logo, and our software are owned by Creathink One. These Terms do not grant you any rights to our trademarks or source code beyond the right to use the hosted service.
8. Third-party connections
When you connect a mailbox (SMTP/IMAP or Microsoft 365), you are also bound by that provider's own terms. We are not responsible for the availability, security, or policies of third-party services you choose to connect.
9. Disclaimer of warranties
Seegnals is provided "as is" and "as available." We do not guarantee that emails you send will be delivered, avoid spam folders, or receive any particular response rate. Deliverability depends on factors outside our control, including your own sending reputation, content, and list quality.
10. Limitation of liability
To the maximum extent permitted by law, Creathink One will not be liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities, arising from your use of Seegnals. Our total liability for any claim relating to the service is limited to the amount you paid us in the 3 months preceding the claim.
11. Termination
We may suspend or terminate your account for breach of these Terms, non-payment, or conduct that risks our infrastructure or other customers' deliverability. You may close your account at any time from your workspace settings or by emailing us.
12. Governing law
These Terms are governed by the laws of Poland, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you may have under the law of your own country of residence.
13. Changes to these Terms
We may update these Terms as the product evolves. We will notify you of material changes by email or in-app notice before they take effect. Continued use after changes take effect means you accept the updated Terms.
